In a significant ruling, Justice J.C. Doshi stated that railway authorities must compensate anyone injured or killed within station premises, including waiting areas, booking offices, and platforms. The judge’s decision came as the High Court addressed the case of a man who died after falling from his train berth due to a sudden jerk.
The deceased’s heirs had originally sought ₹8 lakh in compensation, but their claim was denied by a lower tribunal. Frustrated with the rejection, they turned to the High Court for relief. In its recent judgment, the court found this initial denial to be illegal and ordered it to be set aside.
Justice Doshi emphasized that Section 123(c) of the Railway Act is designed to support victims of unfortunate incidents occurring on railway property. “This provision is meant to aid those affected,” he noted during proceedings.
As a result of this ruling, the heirs now have another opportunity for their compensation claim to be considered properly by relevant authorities. This decision could change how such claims are handled in the future, holding railways accountable for passenger safety across all areas of operation.
