A major relief is expected for traders under the Goods and Services Tax (GST) system, as tax officials will now issue a pre-show cause notice before sending a formal show cause notice (SCN). Through Form GST DRC-01A, traders will be asked to provide details and explanations regarding suspected tax discrepancies.
The new process will give traders an opportunity to present their side, clarify mistakes and correct tax-related errors before formal legal proceedings begin. Earlier, traders could receive a direct show cause notice if investigations or audits revealed short payment of tax or excess claims of Input Tax Credit (ITC). This often left businesses facing sudden legal action and the possibility of heavy penalties.Under the revised process, traders will get an opportunity to respond to the tax department’s preliminary findings before further action is taken.
What information will the pre-show cause notice contain?
If a GST officer finds discrepancies during an investigation, audit or verification of a trader’s records, including short payment of tax or wrongful claims of ITC, the officer will first issue a pre-show cause notice. The notice will mention the relevant tax period, the amount of tax allegedly payable and the preliminary calculation of applicable interest and penalties. It will also explain the reasons behind the department’s demand.
This will allow traders to examine the discrepancies, submit their explanations and take corrective action, wherever required, before the matter proceeds to a formal show cause notice.
