The Board of Nominees Court has restrained a pre-primary school from operating in a residential property in Ankur Society, Naranpura, Ahmedabad, citing violations of the society’s bylaws.
The court observed that approvals from other statutory authorities do not automatically permit the commercial use of residential property if it violates society rules. It also referred to precedents set by the High Court and Supreme Court.
The case was filed by Ankur Society after it discovered that one of its members had leased the property to a third party without obtaining the society’s approval. The property was subsequently converted into a pre-primary school.
The society argued that the school’s operations could disturb residents, increase traffic and parking congestion, and create safety risks. It also sought action against unauthorised structural alterations to the property. The defendants requested a brief stay to file a revision petition before the tribunal.
The court granted an interim stay for two days, until October 29. However, the society immediately challenged the relief granted to the defendants.
