Three Indian nationals on H-1B visas were denied entry into the United States after returning from India, reportedly due to overstaying beyond the permitted period, according to a social media post.
Despite having letters from their employers and documented reasons for their extended stay, US immigration officers cancelled their visas and asked them to return to India.
A social media user, nris_adda, shared the account of one affected individual who was stopped at Abu Dhabi airport. According to a text message from the individual, US immigration officers reviewed their documents and denied entry under rule 22 CFR 41.122(h)(3) — which allows visa cancellation at the port of entry.
The message noted that all proofs of emergency, employer approvals, and attorney support were presented, but immigration authorities still proceeded with visa cancellation and deportation.
The three individuals had stayed in India for over 60 days — one for 2 months and 27 days, and the others for over 3 months. All three are now returning to India, with one flying to Bengaluru and two to Hyderabad.
The incident has raised concerns among H-1B visa holders about travel duration and re-entry policies, especially in cases involving emergencies.
