Students had enrolled for five-year integrated law course from Khyati Institute, which shut mid-way
The HC has come to the rescue of students of the five- year integrated law course that was earlier run by Khyati Group and has directed the Bar Council of Gujarat (BCG) to process their provisional Sanad as per the norms.
The students had moved the HC after the college shut down due to insufficient number of students and later the court had ordered that the students be accommodated in government run colleges.
As per the case details Vishnu Suthar and five other students in a petition before the HC submitted that they successfully completed the LL.B course and graduated in 2023. They had joined the Integrated 5 year Law Course at Khyati Institute in the academic year 2015. The college was affiliated with the Bar Council of India up till 2015-2016. Thereafter, due to certain reasons, the Khyati Institute of Integrated Law was shut down in 2020-2021. Accordingly, all the students who were studying in the said course were transferred and a request was made to the Gujarat University. The petitioners, thereafter, graduated from the Centre of Excellence, Gujarat University in 2023-2024. The students then applied to be enrolled with the Bar Council of Gujarat for a Provisional Certificate of Practice but were not granted one.
The HC then granted relief to the students and asked the BCG to pro- cess their application to provide a provisional Sanad.
“It appears that the petitioners have passed out from the Centre e of Excellence, Gujarat University, Ahmedabad, which is a recognized institute and as the previous college has already been shut down, prima facie, the petitioners are entitled to have their applications processed,” stated Justice Aniruddha Mayee.
The High Court order was issued on October 23.
