The Ahmedabad district consumer forum has held the Western Railway responsible for delay in arrival of a train and ordered full refund of the ticket cost, apart from cost of litigation and compensation for mental agony.
As per case details, city-based advocates Hemang Trivedi and Gaurav Vyas had travelled to Ujjain on August 20, 2022. They had booked a return ticket on Kolkata-Ahmedabad Express on August 19 via Tatkal scheme. The train was scheduled to depart from the Ujjain station at 9.35 pm on August 21 and its scheduled arrival time in Ahmedabad was 7.15 am next day.
However, the train was five hours late and it was announced that it would arrive in Ahmedabad around 11 am on August 22. Since the duo had to reach the court, they bought two tickets in Shanti Express. Meanwhile, they cancelled the ticket of the earlier train. However, when they sought a refund, the Western Railway denied it. Subsequently, they filed the case in the consumer court. The court directed Western Railway it to pay full refund of Rs 3,300 with 9% interest from the date of booking besides Rs 5,000 and Rs 2,000 respectively towards mental agony and litigation cost.
