A man and his family were detained by the Haveli police in Ahmedabad on Monday under the relevant provisions of the Muslim Women (Protection of Rights on Marriage) Act, 2019, for abandoning his wife after issuing the invalid triple talaq to her. The police have also charged the accused for domestic violence, causing voluntary harm, and abusing the complainant based on the woman’s complaint.
In the FIR, the complainant Mubassira Qureshi claimed that on January 25, during a routinely tense argument with her in-laws, her husband Shoaib Qureshi pronounced the triple talaq. The complainant claims that the accused then forcibly removed her from her marital residence and abandoned her. They have been married since October 2021, and their daughter is six months old.
In the FIR, the complainant has stated that she had been “tortured and physically assaulted” by her in-laws, including her husband’s paternal aunt, and also verbally abused over trivial differences. The complainant has urged the police to initiate a probe into the triple talaq citing the act that invalidates the divorce.
Shoaib Qureshi, his parents, and his aunt have been detained by the Haveli police on charges of domestic violence [498(A)], intentionally inflicting bodily harm (323), using abusive language [294(b)], and violating the Muslim Women Protection of Rights on Marriage Act, 2019.
