The Gujarat high court on Friday sought replies from the state government, the AMC, and Mahatma Gandhi International School (MGIS) and its trust in response to a PIL alleging that the school administration violates the condition of granting free admission to municipal school students on the 20% reserved seats.
The AMC decided in September 1997 to hand over Municipal School No. 20 in Mithakhali to Ideal Foundation for private operation.
To make way for private admissions, the AMC relocated its students to other corporation-run schools. One of the conditions for the handover was that the school admit municipal school students to 20% of its total seats.
Qureshi alleged that the Ideal Foundation’s school had broken the terms of the trust deed it had signed with the AMC by refusing to admit poor students. According to the deed, the school is required to admit 20% of students from AMC schools in grades 1 to 7, but it has never done so.
He also highlighted the fact that as per the rules under the Right to Education Act, every school has to give 25% admission to poor students from its total seats in standards 1 to 7.
The PIL sought to take action against law breakers in addition to directing that poor students be admitted and educated at no cost in accordance with the provisions of the trust deed.
