An Ahmedabad-based Gujarat High Court lawyer whose three-month-old car which he bought for Rs 26 lakh was damaged by Tata Motors dealers.
He has filed a complaint in the case after struggling to get his car replaced.
According to the car dealers, they (the person who hit the car) have offered to pay for the damages and that replacing the car is not possible due to company policy.
Advocate Akshay Matani bought a Tata Safari XZA Dark Edition on January 21, 2022, from the showroom of Progressive Cars Pvt. Ltd., a Tata Motor car dealer on SG Highway near Crown Plaza Hotel.
“At the time of delivery, I had requested them to get the Pre Delivery Inspection (PDI) of the vehicle done to ensure that it doesn’t have defects,” Matani said.
He said despite the request the dealer told him that PDI cannot be done as the car was already checked and is in working condition.
Matani’s FIR in the matter mentioned that his car (registration no. GJ 38 BC 9433) met with an accident on Saturday while an employee of Progressive Cars was driving it.
In an email to the car dealer and Tara Motors, Matani expressed his concern and stated that it was his first car and he was attached to it.
“They want me to continue using a vehicle that had technical issues from the beginning, and after the accident. Why should I use a repaired car with a depreciated value for no fault of mine? Why would anyone accept it?” asked Matani.
He said his concern has not been addressed despite reaching out to various officials of the company.“When the accident occurred, I had no option but to seek help from the law,” said Matani.
When Matani inquired about the accident he found that an employee of the dealer was allegedly driving it rashly and had taken a U-turn without first checking in the opposite direction. As a result, a car hit Matani’s vehicle from behind, the FIR states.
Jayesh Parmar, the General Manager of Progressive Cars Pvt Ltd., said the employee was cautious while making a ‘U turn’. Mr Matani’s car was hit by a car that is willing to pay for the damages, but he refuses to accept it because his car is new and he has other concerns. These are two separate issues, according to Parmar.
